How long will my case take to finish?
It depends. The first thing to learn and remember is that your case, like every case, is unique. Therefore, this question (which everyone has) cannot be answered in a general way, but depends on the facts and circumstances specific to your situation. Your case will be filed as quickly as possible and set for trial in the same manner. Trial settings are an important factor in judging when cases will settle. Some complex cases can take 2 years to resolve; less complex cases take less time.
A substantial majority of lawsuits settle out of Court. Indeed, many trial courts prefer settlement to trial. C. COTTEN LAW always works to get a fair settlement for clients. However, if a fair settlement cannot be reached, C. COTTEN LAW will take any case it files to trial.
Not unless there is a trial, and possibly not even then.
Who decides what a fair settlement is?
You do. I will advise and counsel you but the decision is yours.
Just like the question of time, a case’s value depends on the specific factors involved. Call or email me to discuss.
What is the difference between a fee and the costs?
A fee is what is paid to C. COTTEN LAW for legal services. The fees comes from a percentage of any judgment or settlement. You pay nothing out of pocket. Costs are monies paid to litigate the case. These can include filing fees, records, court reporters, expert fees and other necessary expenses.
Do I have to pay the costs for filing or litigating my case?
No. C. COTTEN LAW fronts the costs of litigation. If there is a paid judgment or a settlement, the costs are recouped from that amount.
